Acceptance of Terms of Use at Scrapbook-Bytes
By visiting this web site, located at http://www.scrapbook-bytes.com and/or http://scrapbookbytes.com, and participating in the features and services offered (including contests, challenges, gallery uploads, forum postings and reading, private messaging, emailing from our web site features, etc.) you agree to the terms listed below and to our privacy policy here.

Conduct - Message Board / Forum / Gallery

• No profanity - our message board / forum will automatically filter foul and profane language used.
• No verbal abuse / attacks, spamming, flaming, and name calling will NOT be tolerated. We reserved the right to remove any post we feel falls into this category.
• Cross posting is not allowed in the message board / forum. This would include posing the same thing in several different areas (forums) of the message board.
• You agree that you will not collect personal data (including the harvesting of emails) for any reason.
• You agree that all information posted on Scrapbook-Bytes is not unlawful, illegal, threatening, abusive, etc. (i.e.: you will not submit pirated music, copyright material, etc.)- Scrapbook-Bytes is not responsible for users that violate this term. We resever the right to remove violators from Scrapbook-Bytes.
• You agree that you will not misrepresent yourself or your company at our site.
• You agree that you will not send spam mail, chain letters, viruses, etc.
• You will not use our site / gallery / message board / forum for commercial use. We do permit linking in the www area in your profile (through the control panel of the message board) and in your signatures on the web site; but blatant personal ads to any site - whether it is personal or private or commercial (this would entail frequent pushing of a site or sites on a regular basis) are not permitted at Scrapbook-Bytes.com
  • This does not include links to helpful resources (and as long as it is not "pushing" the link)
    • i.e.: I found the best Photoshop Filters! (and then a link to your great find).. .it is permitted to post a link like this once but if it is found several times within the forums the thread/s will be removed from the web site.
    • Some linking issues are at the discretion of Scrapbook-Bytes and pending the amount of complaints and/or reported posts received by members of the message board / forum / gallery.
    • Linking to other sites is permitted when giving proper credit (I.e. Downloaded background map from site http://www.xxxxxxmaprus.com)

Content Submission (General Guidelines / Terms)

• We reserve the right to remove any content deemed inappropriate at anytime without notice.
• We reserve the right not to publish graphics or content to our web site with or without notice.
• We reserve the right to block any user from content and/or our web site with or without notice to the user prior to this course of action taking place.
• You agree that anything you upload to our web site, Scrapbook-Bytes.com, is your own and that you have all legal rights to the content placed on our web site.

Gallery

• Our gallery exists merely as a means to share scrapbooking layouts and related materials. The gallery is not to be used to upload for personal use or for element downloads. Elements intended for download should be submitted to scrapbook-bytes.com here.
• The images uploaded to the gallery may be viewed publicly both in the gallery and on Scrapbook-Bytes.com (home page). NO profane, vulgar, or other inappropriate materials are to be posted in the gallery.
• All images uploaded to the gallery at Scrapbook-Bytes can be edited and deleted by the user who uploaded the photo and/or the Administrator of the site only.
• Due to child pornography on the web - layouts containing child nudity the we deem inappropriate (or other members deem inappropriate via contact with the Administrator or otherwise) will be removed from the gallery. Said layout upload may be re-uploaded to the site after proper discretion is taken to the photos in the layout that were found offensive.
• Please be respectful of members who upload their layouts to the gallery. Each layout is copyright to the original creator of the layout. It is permitted to "scraplift" (copy another person's layout) - but credit MUST BE GIVEN to the original creator. Scraplifted layouts cannot be submitted to any magazine (paper or electronic) - this violates the original creator's copyright.
• When using page kits from the Tid-Bytes EZine (free or paid versions) you MUST GIVE credit to the creator of the kit and what issue of the Ezine it is from. You may and should refer to Scrapbook-Bytes.com as SBB (and a link back to our site is optional as we realize some sites will not allow linking to other sites from it's galleries and forums).
• Scrapbook-Bytes is not responsible for any copyright infringements between members. This type of issue is to be resolved between parties involved only - unless the infringer involves a Design Team Member. If this scenario involves a Design Team Member at Scrapbook-Bytes.com - please notify the team member directly and admin@scrapbook-bytes.com
• You agree to credit the original creator of the elements (if used) if downloaded. This is proper etiquette and is required when posting the gallery.
• No direct linking to commercial / for profit sites allowed. You may post a "title" of the site for credit; members may contact you privately to obtain additional information if needed.
• It is not permitted to upload "paper" or "traditionally scrapped" layouts to the Scrapbook-Bytes gallery. Our site is dedicated to Computer Scrapbooking / Digital Scrapbooking only.

Elements

• All elements are copyright the original creator.
• Changing of elements is not permitted without permission from the original creator of the element. This violates the creators artistic ability and time involved to create the element for download. Be respectful of the element creators who provide this as a free feature for all of us to use!
• Elements will only be accepted and uploaded to Scrapbook-Bytes if all requirements are submitted and met with elements. We will notify you of what was missing upon receiving the elements if they are not accepted.
• When submitting elements you agree that you are submitting original content and that you are the original creator of the submitted element/s.
• When posting a layout using elements downloaded from our web site it is required to list proper credit. By not giving credit to the original creator of the elements -- this is misrepresenting yourself.
  • How to give proper credit
    • Name of site downloaded from.
    • Name of creator - most often the name of the creator is attached to the file name you downloaded.
      • the above is EXTREMELY important in this realm of scrapbooking.
    • SAMPLE:
      • Downloaded from Scrapbook Bytes (or SBB), tack - Kristie's; background - Shelleyrae's
    • Continued abusers of this term will be sent a request to properly credit creators.
    • Improperly or non-credited elements to the peoper creator is considered using an element from Scrapbook-Bytes against the terms of use.
• Downloading elements from Scrapbook-Bytes does not change copyright from the original creator. The original creator will always remain the copyright holder of their creation. By downloading elements from our web site you agree that you are merely "borrowing" these elements from the site and/or the creator and credit is REQUIRED! Consider the elements "shareware"!!! Frequent violators of this policy will be removed as a member from Scrapbook-Bytes.
• It is NOT PERMITTED to link directly to any element on this web site from another outside web site (i.e.: linking directly to a download from another site's message board).
• The Elements area of the forum / message board are meant for sharing files directly (via inclusion or attachment) or for asking about elements on our website directly or otherwise. This area is not to be used to link directly to elements that are not included on Scrapbook-Bytes or to sites that are for profit.
• Frequent violators of the above terms for elements will be removed as a member from Scrapbook-Bytes if repeated reminders / warnings have been issued.

Disputes
All disputes will be private and confidential between the user and/or the site administrator and/or the parties involved. Scrapbook-Bytes.com is not responsible for any dispute that occurs between users. Some instances have brought our attention to "scraplifters" or stolen content. If Scrapbook-Bytes.com is approached with the dispute that an elements or layout has been "lifted" by the Administrator or one of the Scrapbook-Byes.com Design Team - we will require visual proof before the item is removed from our site. It is the ultimate decision of Scrapbook-Bytes.com to remove the infringing and/or "lifted" content. If the dispute is credited as such the layout/element will be temporarily removed from our site until the issue has been resolved. If resolution is not reached by all parties involved the layout/element will not be re-listed on the Scrapbook-Bytes.com site.

Passwords & Usernames
Each member / user is responsible for their own Username and password information. Scrapbook-Bytes highly encourages each user to keep their private information (log in information) private. We cannot be held responsible for private information that is given out by the user / member to others. You agree to notify us immediately if it is found that your Username and/or password have been used in an abusive, intrusive and/or unauthorized manner (i.e.: someone posted under your Username and you didn't create the post - someone else had access to your account).

Advertising
Scrapbook-Bytes reserves the right to refuse advertising opportunites on our web site to any member / good / service. Reasons for this could include distateful content, inappropriate content, non-related site content, copyright violations (either present or in the past).

Links / Third Parties
Scrapbook-Bytes is not responsible for the terms of use or privacy policies of sites that are linked from our web site - whether it is listed in our resources, the forum/message board, gallery, or from another member of Scrapbook-Bytes.

Indemnification / Disclaimer

EZine / Newsletter
You agree, by downloaded and reading our Ezine / Newsletter, that you will credit all sources for kits and elements downloaded. Any element downloaded from the Tid-Bytes EZine or site newsletter cannot be altered in any way other than changing color. It is not permitted to seriosly alter or deface an element or kit without permission from the original creator of the kit / element.

All articles printed in the EZine and/or Newsletter are copyright the writer / Design Team Member who wrote and/or submitted their article for public viewing. No portion of any article may be duplicated or reproduced without the permission of both Scrapbook-Bytes and the original writer / creator of the content.

You agree that no portion of the Tid-Bytes EZine or site newsletter is to be linked in any way. Only subscribers (either paid (EZine) or free (newsletter)) are to have access to either informational publication. If it is found that you are linking directly to either publication - you will be asked to remove the link immediately. If after a request for linking has not been acknowledged (by not removing the violating linking) as requested by Scrapbook-Bytes; it is at the discretion of Scrapbook-Bytes to remove the user as a member of the site for violation of terms.
